A Joint Grievance Mechanism Approach

With the signing of the Memorandum of Understanding on their collaboration, PST and the Fair Wear Foundation are setting a milestone for long-term cooperation on grievance mechanisms. Members of the Partnership for Sustainable Textiles can now use the Fair Wear grievance mechanism at their own cost without being a Fair Wear member. Would you like to know how? Read the Q&A here.

Background

Effective grievance mechanisms are a key element of human rights and corporate due diligence. The UN Guiding Principles on Business and Human Rights as well as the OECD Due Diligence Guidance for Responsible Supply Chains in the Garment and Footwear Sector require companies to provide for or cooperate in providing the remediation of adverse human rights impacts. To make it possible for grievances to be addressed and remediated, brands should establish or participate in effective grievance mechanisms for affected individuals and communities.

This is reflected in existing and upcoming legislation such as the German Act on Corporate Due Diligence Obligations in Supply Chains, and the EU CSDDD which will gradually require companies to ensure the availability of effective grievance mechanisms in their supply chains. While the development of allowing more workers to access remedy is welcome, the large number of existing grievance mechanisms poses certain risks. Unmanaged and uncoordinated, too many ineffective grievances run the risks of creating confusion for workers, duplication of resources, inefficiencies, and a lack of accountability for companies.

Cooperation with Fair Wear – long-term solution for a jointly accessible grievance mechanism

The collaboration with Fair Wear allows PST member companies to access Fair Wear’s Grievance Mechanism in countries where Fair Wear has local teams (i.e. Bangladesh, India, Bulgaria, N. Macedonia, Romania, Tunisia, Turkiye, Vietnam). When joining the Fair Wear Grievance Mechanism, the PST member brands will also join the HRDD Academy – an interactive learning platform, powered by Fair Wear – to deepen their knowledge on the topics of HRDD and access to remedy.

Building on a completed pilot – the Partnership Initiative Joint Grievance Mechanism

The cooperation between PST and Fair Wear is a direct result of the Partnership Initiative “Joint Grievance Mechanism” that was completed in 2024. In response to a new regulatory landscape and considering the risks of numerous grievance mechanisms being set up, without proper management or coordination, Fair Wear and the Partnership for Sustainable Textiles tested coordinated approaches for access to remedy in a pilot. Based on the premise that coordinating grievance mechanisms can reduce the risks of duplication and provide rights holders with more effective access to remedy, Fair Wear and the PST piloted a model for a jointly accessible supply chain grievance mechanism in two phases:
